When your wall crosses certain heights, a permit and engineering may be required. Here is what northern Illinois homeowners should know.

Retaining walls are one of the most practical outdoor improvements you can make — they solve slope and erosion problems while adding definition and usable space to your yard. But depending on the height and location of your wall, you may need a permit before breaking ground. Here's what most northern Illinois homeowners need to know.

In most Illinois municipalities, retaining walls under 4 feet tall (measured from the base of the footing to the top of the wall) do not require a building permit. This covers the majority of residential landscape walls — garden borders, small terrace walls, and decorative features. If your wall falls under this threshold and isn't near a property line or drainage easement, you can typically proceed with just a contractor and a solid installation plan.

Walls 4 feet and taller are a different story. At this height, many jurisdictions require a permit and, in some cases, engineered drawings stamped by a licensed structural engineer. This is especially true if the wall will retain soil near a structure, driveway, pool, or utility line. The engineering requirement exists because a tall retaining wall holds back significant weight and pressure — if it fails, it fails dramatically.

Even for walls under 4 feet, there are situations that require extra care: walls close to property lines (often governed by local setback rules), walls that affect drainage patterns on neighboring properties, and walls in flood-zone areas. Before any retaining wall project, we always recommend checking with your local building department or village hall — requirements vary significantly between Cook, Lake, DuPage, Kane, McHenry, and Will counties.

The good news is that the permitting process, when required, is usually straightforward. A permitted wall also protects you if you ever sell your home — unpermitted structures can complicate real estate transactions.
